TEMPORARY EXEMPTIONS FROM WEEK-END/HOLIDAY AND SUMMER DRIVING BANS IN MOST PARTS OF GERMANY
Some German regions have issued temporary exemptions from the Sunday/holiday driving ban, as well as from the Summer driving ban (Saturdays on certain motorways) exclusively for transports that are in the context of relief / elimination of the consequences of severe weather damage.

US CONGRESS TO DEBATE AMENDING US SHIPPING ACT
Next month the US Congress will be debating shipping issues too. Two members of the House Transportation and Infrastructure Committee have drafted a bipartisan bill that could see the US Shipping Act amended when it comes up for voting in August.

FMC LAUNCHES AUDIT UNIT TO EXAMINE CONTAINER MARKET
The US Federal Maritime Committee (FMC) has launched a new audit program and dedicated audit team to assess carrier compliance with the Agency’s rule on detention and demurrage as well as to provide additional information beneficial to the regular monitoring of the marketplace for ocean cargo services.

UNREASONABLE DEMURRAGE AND DETENTION PRACTICES AND CHARGES
CLECAT fully supports the recent press statement from FIATA on record high detention and demurrage charges. It refers to recent statements that demurrage and detention charges have doubled, resulting in complaints across the US, Europe and Asia with a reported average increase in D&D charges of 104% over the past year.

UN REVIEWS THE EU CBAM
Following the publication of the European Commission’s proposal for establishing a Carbon Border Adjustment Mechanism (CBAM), the UN Conference on Trade and Development (UNCTAD) issued a study on the potential effects of a CBAM on international trade, CO2 emissions, income and employment, with a special focus on developing and vulnerable countries.

PROPOSAL ON EU CARBON BORDER ADJUSTMENT MECHANISM
On 14 July, as part of the Fit for 55 Package, the European Commission adopted a proposal on a Carbon Border Adjustment Mechanism (CBAM), an environmental policy tool that will equalise the price of carbon between domestic products and imported goods for certain sectors. The CBAM will aim to address the risk of carbon leakage which can undermine EU’s efforts when production is moved elsewhere to avoid EU carbon pricing.

TRAN COMMITTEE ENDORSES EUROVIGNETTE DEAL
The European Parliament’s Transport and Tourism (TRAN) Committee adopted on 12 July the provisional agreement reached between the Parliament and the Council on the revision of the Eurovignette Directive, by 28 votes in favour to 21. CLECAT welcomes the outcome of the vote, as it will allow the transition from time-based to distance-based charging, reducing CO2 emissions.

MEMBER STATES URGED TO COMPLY WITH RULES ON SINGLE EUROPEAN SKY
On 15 July, the European Commission decided to send reasoned opinions to Cyprus, France, Greece, Malta, Portugal and Slovakia for failing to provide and operate data link services for the Single European Sky for all operators of appropriately equipped aircraft flying within the airspace under their responsibility. The decision follows letters of formal notice sent on 15 May 2020, and additional letters of formal notice sent on 18 February 2021.
