DG MOVE PUBLISHES GUIDANCE ON POSTING OF DRIVERS

DG MOVE released this week a Q&A document on posting of drivers in the context of transport of goods by road. The guide aims at a common understanding and a harmonised approach of the posting rules, as the new rules will enter into force on 2nd February.

Drafted by DG MOVE and discussed in the Expert group on posting of drivers, the document outlines the main rules determining whether a driver is posted in one or more host Member States and the administrative obligations of the operator before, during and after posting. The Q&A paper also proposes several scenarios with different operations (international transport, unladen journeys, transit and cabotage operations) to determine when a posting situation starts or ends. The Expert group will continue its work in the coming weeks to discuss remaining issues, including application of the posting of drivers’ rules to passenger transport, road leg of combined transport and operations involving third countries.

The Road Transport Posting Declaration Portal was launched on 21st January. This multilingual public interface must be used by road transport operators to submit posting declarations and other additional documents requested by Member States’ authorities.
