DG MOVE PUBLISHES GUIDANCE ON CABOTAGE RULES

The European Commission has published this week a set of Questions and Answers on the rules of cabotage under Regulation (EC) 1072/2009. The Q&A covers the new rules on cabotage introduced by Regulation (EU) 2020/1055 which entered into force on 21st February 2022. The Q&A provides guidance on the practical application of the cabotage rules, the calculation of the time periods to perform cabotage operation and the cooling-off period or the documentation needed. The Commission also gives examples on how to calculate the time period for cabotage and the cooling-off period, taking weekends and public holidays into account.

DG MOVE also published a set of Q&A on the manual recording of border crossings in tachographs under Regulation (EU) 165/2014. For reference, drivers must enter manually in the tachograph the symbol of the country they enter after crossing a border since 20 August 2020 for vehicles equipped with an analogue tachograph and since 2 February 2022 for vehicles equipped with a digital tachograph. DG MOVE notes that enforcement authorities are expected to apply this provision in a flexible manner taking road safety concerns into account and the flexibility that the concept of “nearest possible stopping place” entails. Enforcement authorities must take all traffic circumstances and road safety constraints into account.  The possible lack of available parking spaces in border areas should be considered to avoid risks of creating dangerous congestions in such areas.
