COMMISSION UPDATES EU DUAL-USE EXPORT CONTROL LIST

On 15 September 2023, the European Commission adopted a Delegated Regulation updating the EU dual-use export control list in Annex I to Regulation 2021/821.

For reference, this Regulation sets out rules throughout the EU to control exports, brokering, technical assistance, transit and transfer of dual-use items. Annex I to the regulation, based on internationally agreed controls, lists the dual-use items that require export authorisation.  The current update, together with an earlier amendment this year, brings the list fully in line with decisions taken in the Multilateral Export Control Regime, an informal and non-binding framework of 50 countries and political entities, designed to coordinate and control the export of sensitive technologies, including weapons, dual-use technologies, and other goods that have potential national security implications.

This latest revision to EU Regulation 2021/821 primarily concerns adjustments to the regulatory guidelines for manufacturing machinery, high-performance computing systems and lasers, as well as the inclusion of propulsion engines for underwater vehicles and technology related to the development of aircraft gas turbine engines. Additional modifications include refinements to technical definitions, annotations, and descriptions, along with editorial amendments. Should neither the Council nor the European Parliament voice objections within a two-month period, the Commission Delegated Regulation is set to be published in the Official Journal and will become effective the day after its publication.
