EC URGES MEMBER STATES TO TRANSPOSE THE DIRECTIVE ON POSTING OF DRIVERS

Last week, the European Commission sent reasoned opinions to Croatia, Italy, Cyprus, Luxembourg, Malta, the Netherlands, Portugal and Slovenia for failing to communicate the national measures taken to transpose Directive (EU) 2020/1057 on the posting of road transport drivers.

Member States had until 2 February 2022 to fully transpose the Directive. The Commission has decided to issue these reasoned opinions to the eight Member States concerned giving them two months to respond and take the necessary measures. In the absence of full communication of all national implementing measures, the Commission may decide to refer the cases to the Court of Justice of the European Union.

While other Member States communicated the national measures to implement the Directive, Member States also need to publish information on their national website such as the remuneration of posted drivers in EU countries. As of today, 6 Member States (Croatia, Czechia, Greece, Luxembourg, Malta and Romania) did not communicate this information on the “Your Europe” portal. CLECAT therefore urges Member States to publish and share information on the remuneration of posted drivers in the EU.
