EC PUBLISHES LIST OF SERIOUS INFRINGEMENTS

The European Commission published on 7 October a draft implementing Regulation updating the list of serious infringements which may lead to the loss of good repute by a road transport operator. The draft act results from the publication of the Mobility Package I Regulations which add new infringements that could lead to loss of good repute, introduce an additional criterion when defining the degree of seriousness of infringements and their frequency of occurrence.

The new serious infringements that may lead to the loss of good repute by road transport operators are infringements to the law applicable to contractual obligations, cabotage and posting of workers in road transport. The draft act also adds infringements leading to risks of serious injuries or fatalities to the list of serious infringements. The risk of distorting competition in the road transport market has been added to evaluate the level of seriousness of the infringement.

The implementing regulation is expected to be adopted by the Commission by the end of the year. A feedback period has been opened until 4 November. Stakeholders are invited to give their views on the draft act via this link.
